Two Veterans of Litigation and Mediation Join to Create New Firm
KANSAS CITY, Mo. (September 22, 2021) – Lawyers in the Midwest soon will have more options to mediate employment litigation and other disputes. Founded by two trial-tested litigators, Eischens + Vogel Mediation Solutions will launch on November 1.
The new business marks an evolution for Eischens Mediation Services (EMS), which was founded by Joseph Eischens in 2016. For the past five years, EMS has provided mediation services in civil litigation matters nationwide.
With the addition of David Vogel, the firm adds not just capacity, but a complementary perspective. Before starting EMS, Eischens focused his private legal practice on plaintiffs’ litigation, representing employees in all phases of employment and other disputes. Vogel, currently a partner at Constangy, Brooks, Smith & Prophete LLP, specializes in employment defense work; he has spent more than two decades defending some of the nation’s largest companies in litigation across the United States.
Because the founders of Eischens + Vogel Mediation Solutions have nearly 50 years of collective experience in the practice of law, Eischens said they can offer an empathetic and efficient approach to dispute resolution.
“We have been in the trenches,” he said. “We understand the pressures inherent in managing risks, budgets, stress and client expectations, and we are able to apply this knowledge to provide cost-effective problem-solving. We believe this is an advantage over other neutrals, who may not have direct experience managing both caseloads and clients, and carrying matters through the discovery process and trial.”
Eischens + Vogel Mediation Solutions will mediate a number of dispute types, among them:

Before joining to create Eischens + Vogel Mediation Solutions, the founders had years of professional interaction. First, they were litigation adversaries; later, Eischens mediated several disputes for which Vogel was defense counsel.
Even on opposite sides of a matter, Vogel said the two developed strong rapport and respect.

At Eischens + Vogel Mediation Solutions, the principals will be joined by Joe Knittig, CEO of The Global Orphan Project and part-time mediator, and Angie Fisher, who will serve as office administrator. Both Knittig and Fisher now serve at EMS.

JOE EISCHENS, Mediator/Attorney

Over the course of his legal career, Joe Eischens represented hundreds of individuals and companies in all phases of litigation, including 20+ trials and over 500 mediations. In 2003 Joe completed mediator training at the University of Missouri and now serves as a skilled, knowledgeable mediator in most civil-related matters throughout the Midwest. He has served as a mediator in over 1,000 cases and has a high resolution rate. He has been recognized by his peers as a Missouri and Kansas “Super Lawyer” in Labor/Employment Law and/or Mediation every year since 2007. Joe brings a unique “everyman’s” perspective to his mediation practice and believes that his success as a mediator stems from his ability to listen intently to both sides, empathize with each party, and creatively work through difficult situations to reach successful resolution.
Born and raised in Jordan, Minnesota, a small town that values honesty and hard work, Joe’s humble upbringing inspired him to devote his career to problem solving. His father was a plumber and his mother a homemaker for Joe and his nine (NINE!) lively siblings. Being the youngest of ten provided Joe with a fertile training ground for conflict resolution and a natural beginning for his success as an attorney and a mediator.
He received his B.A. degree in Communications Studies from Gustavus Adolphus College in St. Peter, Minnesota, in 1987 and his J.D. from William Mitchell College of Law in St. Paul, Minnesota, in 1992. After moving to Kansas City, Missouri, in 1993, Joe focused his litigation practice on employment-related matters (including discrimination, wage and hour, whistle-blower, workers’ comp retaliation, FMLA, FLSA, breach of contract), personal injury and product liability cases, and other related civil matters. He carried this vast litigation experience into a successful mediation practice, one in which both plaintiffs’ and defendants’ attorneys actively seek his services.
Joe is a certified mediator in both Kansas and Missouri state and federal courts. He has given lectures on issues involving employment discrimination, sexual harassment, jury selection, depositions and discovery, and best mediation practices. He has provided mediation, harassment and discrimination training to human resource professionals and corporate general counsel.
Outside of his professional practice, Joe served as the President of the Board for the Cutaneous Lymphoma Foundation where he is a staunch patient advocate for those afflicted with this rare form of cancer.

Joe’s mediation credentials and litigation experience allow him to conduct mediations anywhere in the nation. He has conducted mediations in Kansas City, Jefferson City, Columbia, St. Louis, and Springfield in Missouri; and Wichita, Topeka, and Johnson County in Kansas. In addition, Joe has participated in mediations in throughout the United States. EMS receives numerous referrals from previous clients and welcomes the opportunity to provide mediation services in locales that are desirable and accommodating to all parties.
Since the COVID-19 pandemic began, EMS conducts most mediations via Zoom teleconferencing, enabling participants to attend mediation seamlessly from all over the world.

DAVID VOGEL, Mediator/Attorney
With 25 years of experience in the trenches of employment defense litigation, David Vogel learned what it takes to succeed at trial – and also learned that things did not always go as planned. Dave is now putting that knowledge to use as a mediator, helping parties resolve their disputes before they reach the courtroom.
The Kansas City-area native earned his law degree in 1996 from the University of Missouri-Columbia School of Law, finishing first in his class. Out of law school, he quickly found his niche in employment defense law, practicing with one of Kansas City’s largest law firms for nearly 20 years before joining a national employment defense firm.
Over the course of his career, he helped large and small businesses across the country work through employment discrimination and other employment-related disputes. He also counseled clients on day-to-day employment matters and handled multiple appeals.
In 2016, after becoming a certified mediator through the University of Missouri-Kansas City, he began mediating cases while maintaining a full case docket. Over time, he came to find that he most enjoyed the mediation portion of his practice, and the challenge and satisfaction of helping both sides resolve their problems.
His goal in mediation is to serve as a true neutral, appreciating the interests, expectations, and concerns of all parties involved in litigation and doing his best to help bring the matter to a close with a satisfying outcome for all.
Dave approaches each mediation with rigorous preparation. Before meeting with the parties, he becomes familiar with the underlying facts, the law governing the dispute, the forum where the matter will be heard, and the judge or arbitrator before whom the parties are appearing.
He is skilled at listening, empathizing with individuals and businesses, and giving the parties a realistic view of their respective case.
As a recent practitioner, he understands the real-world concerns that surround disputes and can give parties a neutral assessment of where their cases stand. He is also adept at conveying the advantages of resolving cases through settlement.
Outside of his legal practice, Dave previously served on the boards of The AIDS Council of Kansas City, Legal Aid of Western Missouri and the Kansas City Free Health Clinic, now known as KC CARE Health Center.
